MTR threatens Sheep with legal action if we don’t censor our posts about her immediately

Just got home to find a letter from the lawyers of Melinda Tankard Reist demanding I withdraw all my posts about her or very bad things will ensue.

This is pretty amusing when you read some of the things MTR writes about those she does not approve of.

She’s going to have to sue a few more blogs than just mine, because I’m not the only one who’s written that she’s a Baptist, and attends Belconnen Baptist Church. It’s well in the public domain.

And how bizarre it is that someone who is a devout Christian is so cagey about her faith and her practice? Why not be open about her religious faith? Christians usually are. What does she have to hide?

At least I know now why Rachel Hills didn’t ask those questions, or if she asked the questions, didn’t publish any answers!

“Write about my religious beliefs and I’ll sue you!” Now that’s novel.

If you want to see just how cagey MTR is about this watch this interview with ABC TV’s Jane Hutcheon when Hutcheon asks about her religion and how it affects her work. She tries to follow Jesus, she says, but she doesn’t want anybody focusing on her religion because that will distract from her work.

Well, we might all be about to find out just exactly what MTR’s religious faith is, because she’s going to have to come clean if she wants to sue me.

Just when you think things can’t get any more bizarre…

    It is a cowardly thing to coercively censor out dissent- what you’d expect from an ultraist, but might have been more constructive if she had engaged with some of the issues raised here.
    Or did she lack the courage of her convictions.
    Censorship is no substitute for honest discussion. She’s handed Jenny victory on a platter in the War of Ideas through a refusal to engage and to present her ideas for consideration, as should be the case.
    What has she to hide, that she must resort to this?
    Her own ignorance?

    Very amusement. Surely the philosophical basis, religious or otherwise, of a writer’s worldview is absolutely central to forming an understanding of that worldview. Personally, I find the issuing of legal threats on a subject central to an author’s writing to be the hallmark of a bully and a coward. My opinion of MTR’s intellectual honesty, already pretty low, just plummeted another six notches.

    Hi Jennifer,

    You’re not the only one to face such a threat from MTR. I seem to recall that she once said that she believed the best tactic was to ignore her online critics. The criticism must be beginning to hurt. In any case, it’s a tactical mistake on her part. Very few people appreciate silencing criticism.

        I suspect that some people she has been associated with through Spinifex are beginning to back away because of her religious links. Being associated with feminist academics has helped her credibility. To have them begin to distance themselves will hurt.

    It’s the same as the censorship tactic that was used against me when I first wrote about the story that will now be shown in film and the same as the tactic used by Amanda Vanstone for calling her a fucking liar and having 2 burly AFP on my doorstep, something it seems they still do.

    And the same as the tactics employed by ASIO to keep babies jailed as a “security” risk.

    I do not like censorship by anyone.

    Russell Skelton tried to sue me once because I showed him up to be a liar and fraud – I sooled a renowned barrister on him and never heard from him again.

    As for MTR, she needs to go and join the tea party but she should not be censored either, even by herself.

    Come on Melinda dear, do tell us all about your religious nut baggery because if adults want to make or watch porn it is their business.

    of course if it involves snuff films, actual rape and children they should be lined up against a brick wall.

      I don’t mean to be nosy (although that’s what I’m doing) but if you are, I’d just like to thank you for your doggedness and voice (one of a handful) of common sense in the wilderness. If not, I’m still a little shocked (I shouldn’t be, but I do hope for the best) that Amanda would send some heavies around to shut you up. Democracy for some…

    What does it say if you think your religion distracts from the message? I suspect you know the answer. The public tends to turn off when they know you are pushing a religious agenda so she’s tried to hide it and promote herself as a secular feminist. It’s dishonest.

    Of course, she’ll try and argue that is irrelevant, but it is very relevant.

        Yes, I know – its what bullies do. It’s consistent with all her actions – intimidation, threats to boycott, petitions – I wasn’t all that surprised when the letter arrived. No suggestion of mediation.

    Marilyn, you are well entitled to maintain the rage regarding the still unresolved asylum seeker situation that causes so much unnecessary suffering- we should be aware of the consequences that would be visited upon us should we ever become so careless as to take our freedoms for granted and wake up to find ourselves in such a situation. Only in the honouring of other people s needs will we shore up our own lives, as Niemoller and others pointed out

      No, unfortunately I can’t. Of course MTR is very welcome to reply and I would certainly publish any communication from her. Her lawyer’s letter of demand isn’t for publication.

      I think it’s significant that this is her first port of call – the lawyers, the threats, the attempts at intimidation. She could have very easily written a piece refuting everything I wrote, and put it up on her blog and mine. However, she chose the bullying path first off.

        Jennifer, it is standard for defamation letters from lawyers to include a sentence that states “This letter is not for publication”. There is absolutely no legal standing for that and its part of the satdnard scare mongering practice of such things.

    Hello! Was just directed to this via Leslie Cannold’s tweet. I just wanted to note that I believe the story about Queen Victoria refusing to acknowledge the existence of lesbians is not true. I was disabused of this by a Victorian studies professor who explained it thus (if memory serves—it was more than 20 years ago): a law was to be passed that would forbid people of the same sex sharing a bed (which definitely does sound like a anti-gay law, no doubt). Queen Victoria refused to endorse it because it would preclude sisters, female cousins and close friends from sharing a bed when this was in fact very common practice. We err in assessing Victoria/ns as prudish—it’s clear QV enjoyed a very enthusiastic and satisfactory sex life with Albert, and, returning to your theme of anti-porn crusaders, the Victorians were extremely (here’s that word again) enthusiastic collectors of porn. As for MTR, I recycled the magazine she was featured in last weekend without reading it. I’m trying to exclude from my life things that make me rationally but impotently angry, so thanks for fighting the fight for me. Also—hypocrite much, MTR? Jeez.

    Although the whole prude vs porn argument doesnt really interest me, I find it interesting that the usual arguments for allowing some level of pornography tend to lie around : civil liberties, removal of government control over peoples personal choices and a general view against censorship. There are some much more positive arguments that can be put. For instance for those needing sperm donation the use of magazines at sperm banks can assist the collectors efforts, those with dull sex lives can spice it up a little by trying something new – (thinking bored long term partners here), and the knowledge that having a sex life is good for healthy living / general happiness.

    The Baptist Christian thing tends to want to restrict a sex life to only those in married states and willing to procreate…a bit of an extreme example of over controlling dominating behaviour in my opinion. Don’t they have restraining orders for this type of behaviour?

    Disclaimer: I’ve never been much interested in porn as Ive always preferred to be a participant than just a spectator of other peoples efforts.

    I’ve come from Skepticlawyer. Scary stuff this, the treat to sue, if you expose. They shoot messengers, don’t they, though hopefully not always. I admire your courage in standing up to such threats with further exposition.

    You’re certainly not alone Jennifer. I too have been threatened by MTR with legal action, along with receiving threatening and abusive (bullying) emails, from one of her ‘lap dogs’ for telling my truth about my experience of her through a couple of my campaigns. Her wrath laid upon me was due to my association with Leslie Cannold during my Pull the Pin (on beauty pageants for children) campaign. Little did I know that that would be like waving a red rag to a bull. However, instead of calling and speaking with me directly, she contacted personal friends of mine AND MY EMPLOYER in an attempt to undermine me, and I was tossed from her fold faster than I could say ‘Jesus!’. She was most upset with me for sharing an article Leslie wrote calling some child beauty pageant objectors ‘religious psuedo-feminists’, and insisted that I must have known Leslie was referring to her (I didn’t know – or care).
    @Tiga Bu – despite my best efforts and offers to respectfully resolve this with her, mediation was never an option for her. She has since been dogged in her crusade against me, creating a ‘war’ where there wasn’t one and asking some mutual friends whose ‘mast they pin their flag to’.

    I haven’t experienced anything like this since high school – in fact, not even then! It’s very disturbing that this is coming from someone who is speaking out using a supposedly feminist platform. Bullying and attempting to silence others is anti-feminist in my opinion, and all of this takes away from what the real issues are.

    Her threatening email to me said not to reply to her directly but through her lawyers – but she didn’t leave their contact details, and I still haven’t heard boo from them. I wish they’d call ‘coz I have shitloads of emails and messages they’d love. Truth is the best defence to defamation.

    I know I was going to try to resist, but I have to say Jennifer: I think you could take this as your official welcome to the Australian commentariat!

    As to the question of what she has to hide my response would be probably not that much. Look at it in this round-about way: I’m spending a coulpe of weeks in Taiwan hanging out with my other half and her extended family. The presidential election, which concluded yesterday, was fought to a background of uncertainty of over the very future of the country. Despite the successful incumbant Ma Ying Jeou’s ostensibe support for closer relations with China, politics here really is a balancing act between mitigating the threat of being engulfed by China and the knowledge that there is such a depth of feeling surrounding the sanctity of the Taiwanese identity and way of life that any attempt to restrict that would cause wide-scale unrest. In that sense, the current state of detente is almost inevitable, and so Taiwanese people need to live their lives and conduct international trade with the knowledge that any wrong move could contribute either to a loss of self-determination, or to the possibility of some kind of war, maybe involving the US, Australia etc.

    You have said here several times that the issues MTR deals with – pornography, the supposed dissolving of social standards – are pretty insignificant when all is said and done. And that’s just it: if she can get so worked up over your blog that she has to pay people to threaten you (I wonder how much that letter cost her??) then I’d say it’s highly likely she’s a person who is incapable of looking outside of herself and of considering the serious issues that face real people out there in the real world. And it seems you’ve just proven that to all of us.

Given your outright rejection of Christian based morality Jen, do you embrace any kind of philosophy, belief or ethical teachings? Asked merely for information…am curious where your values lie (Understand if you prefer not to disclose on a public blog though)

      I don’t embrace any institutionalized morality. I love many things Jesus said but I have no interest in the religions built up around someone I regard as a thinking human being. I read and appreciate a wide range of thinkers and philosophers but am not tied to “believing” in any of them. I’m just not a believer. I’m not very interested in any theory or philosophy that has no practice. I’ve long been interested in human rights, especially with regard to asylum seekers, women and children.

      I don’t think I outrightly reject all Christian morality, but there are expressions of that morality I do reject. I was educated in a high Anglican convent school, and I had nothing but love and respect for the nuns who cared for me and taught me. But they were nothing like fundamentalist Christians in their outlook.

      See in that YouTube clip where MTR says pornification “has crept up on us through adversiting, through marketing through the goals of global corporations … “they’ve” done 2 things; they’ve targeted children,… and they used sexualised ways of targeting the children” … then brings in the pornography industry … very “gish-gallop”-like in her ongoing ‘commentary’.

      She undermines some good points by conflating a number of issues, and ignores the role of parents and community standards through schools and other civil entities in countering those, until prompted, yet even then implies parents are only “rising up” after being led by organisations such as hers.

    It is good to see Marshall Stacks’ contribution, amplified by Ann O’ Dyne further along the (food?) chain. This ampification emphasises the sorry tale of coercion sympathetically added by another victim, Catherine Manning, an instance that reveals that proto fascism is no joking matter.
    Litigate or perish.
    Those of us attempting to retrieve St Clair Park in Adelaide back from the developers, have been subjected to a similar campaign of threats, trolling etc, from a right wing Labor mp and former cabinet minister, for similarly trying to break through a wall of silence.
    The processes outlined here have been stock-standard formulaic from the right, since they succeeded in gagging Bob Brown over Tassie rainforests, back early in the decade.

    I really, really wish you well.
    My partner & I, artists, have been defending a defamation claim brought against us in Feb/March 2011.
    My partner, whose comments on this matter can be found on her site , expresses similar sentiments to yours when we received such legal documents.
    From our own experience, I am sorry to say that it is probably going to get uglier and far worse. We have so far paid around $40,000.00 in legal fees.
    The Australian legal community does not care…
    In the US they call this a SLAPP.
    As a consequence of the defamation action against us even Telstra disconnected us from the internet. We had to wait a month for re-connection. This is possible in Australia because there are no laws here that protect against what in the US is called “prior restraint”.
    We had to host our websites in the USA.
    Defamation relies on what is called a “reverse onus”, that is, you have to prove you did not defame, rather than your accuser prove their claim. Ugly indeed!
    The law even implies that even though what you have written is true, “truth” is only an excuse, and that you really have defamed the person, but defamed them legitimately.

    Can you please confirm here and now that neither you nor your supporters (supporters being just that, or those registered to your site,colleagues etc)have ever influenced any content on the ABC nor received any preferential treatment.
    Can you also state here or on the ABC Drum that you have never used a pseudonym(or more than one pseudonym) to reply on any ABC online forum/blog or on this blog.

    Ms Reist did you manipulate or filter the data in your book on post abortion females or not.
    If you say no please publish ALL of the raw data minus individual names.

    You ‘appear’ to have a problem with sex melinda.
    What is it?
    Something other than the kitten executions?

    Should the whole of society pay for your insecurities?
    Why is that?

    My final advice MTR?
    Seek non religious professional assistance.It’s not too late.

    And for the record it is really pathetic to bully on one hand the one person who always responded under her own name on her ABC Drum articles while you shape shifted ad infinitum to avoid damaging your brand,

      As someone who writes opinion pieces for a living, including occasionally for ABC’s The Drum, I find this sort of paranoid conspiracy theory hilarious. A vague hand-wavey allegation that the ABC is corrupt because, oh, something happened that you didn’t understand but didn’t bother to actually ask them about. Instead, in the middle of the night, you post a comment on an unrelated story on an unrelated website.

      You know the number one cause of stories appearing online and then disappearing in the middle of the night? Tired editors preparing a story for later publication and accidentally posting it live rather than scheduling it to be posted later — then noticing their mistake and fixing it. A slip of the mouse.

      You know the number one reason editors don’t respond to indignant allegations of conspiracy from the punters? They’re too busy and simply don’t have the time.

      As someone who used to be a producer for ABC Radio a couple decades or more back, I know that when a punter presents “Aunty is as bent as a clock spring” a statement of fact and says, quite clearly, that there’s “no point” because their mind is already made up on that point that there’s little benefit in continuing the dialogue. And yes, I’m well aware of the contradiction inherent of what I’m doing right now.
