Turnbull must urgently clarify whether or not he is entitled to Israeli citizenship.

The S44 citizenship saga has thrown up possible queries concerning the citizenship status of Prime Minister Malcolm Turnbull.

The first is this interview with the Times of Israel in September 2015, recorded when Turnbull ousted former Prime Minister Tony Abbott and took over the top job:

My mother always used to say that her mother’s family was Jewish, he (Turnbull) told the Australian Jewish News two years ago. Judaism is passed from generation to generation on the mother’s side, so if his mother was in fact Jewish, so is Turnbull.

The second is a piece from the Australian Jewish News, August 2013, headlined “Menachem Mandel Turnbull?” in which the same statement is made by Turnbull about his mother, Coral Lansbury.

If Turnbull is Jewish, he is, as is every Jew in the world with the exception of criminals and terrorists, entitled to Israeli citizenship under the 1950 Law of Return.

How does this bring into question Turnbull’s legitimacy as an MP?

Section 44(i) of Australia’s Constitution disqualifies someone from office if that person:

…is under any acknowledgment of allegiance, obedience, or adherence to a foreign power, or is a subject or a citizen or entitled to the rights or privileges of a subject or a citizen of a foreign power… (emphasis mine)

We know from recent events that:

The High Court’s reading of section 44 is strict and unsurprising. It means that a dual national is barred from Parliament even where they were born in Australia, are ignorant of their other citizenship and have never attempted to use the rights or privileges of another country. A person can even be disqualified where they become a dual national later in life due to legal changes in another country.

Obviously his citizenship status and S44 were far from Turnbull’s mind in 2013 and 2015, when the interviews were recorded. Yet  he was, at the beginning of his political career, like any other aspiring MP whose background carries the possibility of dual citizenship or entitlement to that citizenship, required to establish his status before standing for parliament. His failure to do this places his legitimacy as an MP and Prime Minister in doubt.

For the sake of the country’s stability, Turnbull must immediately address these issues, and rapidly and transparently convey his citizenship status to the Australian people. It is unthinkable that we should continue with a Prime Minister who is ineligible to sit in our parliament.

Energy Minister Josh Frydenberg is in the same situation as Turnbull. Frydenberg’s mother is Jewish, and he is also entitled to Israeli citizenship under the Law of Return.

      If the mother is Jewish the child doesen,t automatically take on Judaism there are lots of jews who are secular not religious or who embrace other faiths , I Had a friend who was a Krishna devotee

        According to Jewish law, a person is Jewish if their matrilineal ancestry is Jewish. I’m not saying I uphold that belief, but others do.

    Well, well.

    I respect your intestinal fortitude, Dr Jennifer Wilson.

    If there are real TRAITORS in the system, they are ones much harder to find, who spy for various foreign powers or trans national corporations. I wonder what harm has been done to Australian scientific research efforts, business operations, government independence and privacy as to Australians.

      Every politician/cop/judge who swears an oath to the Crown is committing treason as the Crown is a foreign power.
      An ex-high court judge warned about this in a letter he sent to all judges in Australia.
      In fact, technically every Australian who obeys unconstitutional laws is committing treason… and there are many. As proven by yours truly in court (No proclamation exists for many acts) for these ‘laws’ are made by a foreign listed corporation posing as government.

    As for other destabilisations, we recall the “Falcon and the Snowman” story of CIA involvement in the overthrow of Whitlam in 1975 with help from people actually in the government and more recently, from the same era, allegations of Brit intelligence and Sit John Kerr. People like former Labor MP’s Julia Irwin were long isolated within the ALP for speaking out against the Howes, Arbibs, Feeneys and others.

    During the nineties, much was written of US infiltration of Labor and the unions including through supposed junkets to the US and of course most people know of the junkets to Israel involving Australian politicians and journalists.

    There seems to have been a complete absence of source materials using Google, so must leave things stand- I know what I remember, but…

    It seems a Conservative junior minister in Teresa May’s government is about to be sacked over refusal of disclosure including to the PM herself, involving a visit to Israel very recently.

    ok so does this mean our govt is completely corrupted/been infiltrated? It’s just that God never promised the jewish people land, he promised them a higher state of consciousness. Also if our govt has been completely compromised why hasn’t the Governor General thrown them in jail for treason?

      I don’t know Paul, I would think there are many people who truly believe that the whole point of democracy is precisely to support this kind of jingoism and rapaciousness and if you can get away with it, all well and good. In fact I’d venture to say that people who are slaves to payday loans probably believe this more strongly than most… they just haven’t gotten away with “it” themselves yet.

      BTW that’s my favourite word in the English language: “it”.

        Sorry, just reeling from watching the monstrous perjury of Turnbull, the 65$billion tax cuts for rich people who don’t pay tax man, as to how he is helping the unemployed. I don’t think people on welfare would appreciate the silence on the NAB job cuts, a flooded jobs market, or the vicious microsadism of Centrelink.

        I doubt whether the ragged and tormented souls on Manus and Nauru would feel good about the Champion of the Downtrodden after the last sordid week’s events either.

    Startlingly good point Jennifer!

    I would think that a literalist reading of this would find that he technically isn’t “entitled” to the rights or privileges of a subject or a citizen of a foreign power until such time as he actually takes them up… but it’s worth a try for sure.

    The other question I have is what is a “foreign power”. Could you say that someone who is from, say Mauritius, or Pitcairn, is not from a foreign power since those places aren’t very powerful?

      Ah, but the Constitution makes no distinction between possessing dual citizenship, and being entitled to it. This is bringing many undone who have not taken it up, but have not renounced their entitlement to it either.

      Personally, I say get rid of S44, but that would require a referendum and public hatred of politicians is currently at such a high, a referendum that makes anything easier for them won’t get much much traction I shouldn’t think.
