Who would Jesus sue?

15 Jan

If you are interested in Melinda Tankard Reist’s fundamentalist Christianity you’ll find a biography here with far more detail than I provided, including her affiliation with the Salt Shakers, a Christian fundamentalist organisation founded by, among others, strident anti-homosexual Baptist preacher Bill Meuhlenberg. Meuhlenberg’s latest anti same-sex marriage rant, titled “When darkness descends upon a nation” was written in reaction to the recent ALP decision to support same-sex marriage.

Among other rhetorical gems, you’ll find this comment on Prime Minister Julia Gillard:

And what of Labor’s leader? Did we really ever expect that a fornicating socialist atheist was going to really hold the line on this? Of course not; certainly not when she is in bed with our other leader, a homosexual socialist atheist.

What you will also discover in the Tankard Reist bio is that for 12 years she was employed by Tasmanian Senator Brian Harradine as his bio ethics advisor. During this period Harradine successfully prevented Australian women from accessing the drug RU 486 despite it being available in other Western countries, and the numerous trials that had proven it’s safety and effectiveness as an early abortion drug.

But wait! There’s more! During Tankard Reist’s employment as his bio ethics advisor, Harradine also successfully prevented AusAID,the main Australian government overseas aid organisation, from funding any organisations that provide “abortion training or services, or research, trials or activities which directly involve abortion drugs,” even where it could save the life of a woman.

The Harradine-determined AusAID policy allowed funding for counselling after an abortion, but disallowed the dissemination of advice and education to women in underdeveloped countries who sought safe abortion.

A World Bank Report at that time estimated some 68,000 women in underdeveloped countries died as a consequence of unsafe abortion, and some 5.3 million suffered temporary or permanent disability.

This situation caused Bernard Keane to write this in Crikey, in an article titled “AusAID conservatives have blood on their hands:”

As a consequence of the restrictions, thousands of women overseas have died from unsafe abortions (see Sue Dunlevy’s excellent article from last year for some figures). Those deaths are a direct legacy of Brian Harradine and the Howard Government’s willingness to cater to the medieval delusions of the superstitious.

Tankard Reist’s involvement with fundamentalist Christians opposed to abortion, contraception, surrogacy, and homosexuality are well documented, and I have to wonder why she’s singled me out at this point in time for writing about her religious beliefs.

Throughout her career, Tankard Reist has doggedly described herself as a feminist, despite her anti choice stand, and her willingness to align herself with people such as Meuhlenberg and Harradine, who seek to exert their control over women’s bodies. Tankard Reist appears to be quite comfortable supporting and abetting this urge to dominate and control women, while simultaneously railing against what she considers the objectification, sexualisation, and pornification of women in popular culture.

Tankard Reist apparently has no qualms about having worked for a man whose determination to impose his religious beliefs on government policy prevented women far less fortunately placed than herself  from accessing medical help and education about contraception and abortion. It appears to be of little consequence to her that women in underdeveloped countries suffered and died as a direct consequence of Harradine’s religious beliefs, during the period when he was her employer.

Yet show her a Kanye West video or a Brian McFadden clip, or women in Victoria’s Secret lingerie who like pole dancing, and she’s got petitions going every which way to silence and censor. What’s wrong with this picture?

As I think Jesus is reported as having observed, by their friends you shall know them.

(The title of this post comes from a tweet I received yesterday and I think it’s brilliant.)

UPDATE: I received the letter of demand from Tankard Reist’s lawyers on my personal email address. They state that they’ve sent a hard copy to my home address. I am not in the phone directory and I have no landline in my name. My personal email address isn’t available on my blog and neither is my home address. It probably wasn’t difficult to find someone who would divulge my email address, but my home address?

I can’t speak on the email issue, but hard copy process servers generally obtain addresses from the Electoral Roll. Because voting is compulsory in Australia, this is very easy to do.

Don’t worry too much Jennifer. MTR has just picked you randomly I think because she isn’t getting her way. You can count on me and I hope many others to chip in to fight this oppressive smothering of public debate that I would argue is utterly necessary in a healthy democracy…well, as close as we get to one anyway!

You’re certainly not alone Jennifer. I too have been threatened by MTR with legal action, along with receiving threatening and abusive (bullying) emails, from one of her ‘lap dogs’ for telling my truth about my experience of her through a couple of my campaigns. Her wrath laid upon me was due to my association with Leslie Cannold during my Pull the Pin (on beauty pageants for children) campaign. Little did I know that that would be like waving a red rag to a bull. However, instead of calling and speaking with me directly, she contacted personal friends of mine AND MY EMPLOYER in an attempt to undermine me, and I was tossed from her fold faster than I could say ‘Jesus!’. She was most upset with me for sharing an article Leslie wrote calling some child beauty pageant objectors ‘religious psuedo-feminists’, and insisted that I must have known Leslie was referring to her (I didn’t know – or care).
@Tiga Bu – despite my best efforts and offers to respectfully resolve this with her, mediation was never an option for her. She has since been dogged in her crusade against me, creating a ‘war’ where there wasn’t one and asking some mutual friends whose ‘mast they pin their flag to’.

I haven’t experienced anything like this since high school – in fact, not even then! It’s very disturbing that this is coming from someone who is speaking out using a supposedly feminist platform. Bullying and attempting to silence others is anti-feminist in my opinion, and all of this takes away from what the real issues are.

Her threatening email to me said not to reply to her directly but through her lawyers – but she didn’t leave their contact details, and I still haven’t heard boo from them. I wish they’d call ‘coz I have shitloads of emails and messages they’d love. Truth is the best defence to defamation.

That was right between the eyes; spirited. As Marilyn commented, referring perhaps to Jennifer’s point about numerous deaths through backyard abortion in her comments about asylum seekers, a lot of people actually suffer through the denial of relevant information. Expanding, you can contemplate ethnic purges also, as a consequence of the ignorance induced by censorship practices as well as contempt for the suffering of the masses of “undeserving” third world poor.

Is it possible that MTR doesn’t want her Christianity or past-Christianity to get in the way of her anti-child-sexualisation or anti-porn campaigning ie. she want those campaigns to not be side-tracked by “less relevant” issues?

Where she comes from is relevant, unless the arguments she puts up are good ones. The arguments seem to be good wrt child sexualisation (and her Christianity seems less relevant), but not wrt generalisations about most men and pornography, especially the view pornography is some widespread conspiracy (I am not, however, for promoting porn).

Looking at her website, and some interviews & media appearances, MTR seems as much about self promotion as she is about any issues.

I don’t know all the facts but it seems to me, as a barrister practising in this area, that, assuming what you wrote was even defamatory(?), you may have a number of defences to a defamation suit by this woman, including truth (perhaps contextual truth depending on her imputations), fair comment, honest opinion and qualified privilege – including the constitutional ‘free speech’ on government and political matters recognised in Lange v ABC – subject to malice and acting reasonably. All the material on abortion and backgroud on Harradine etc is likely grist for that mill.
Any case she brings would involve descending into her background and beliefs in great detail and no doubt generating a lot of publicity…

Jennifer, you are my new hero!! i read the smh piece today and thought the only way MTR could pursue a defamation suit against you is if she argued fundamentalist Christians were abhorrent and her reputation has been negatively affected by being associated with them. Oh and if you have truth on your side, thats a decider right there. More power to you, we need more people to carry on the Hitchens fight of asking the hard questions and expecting answers, especially to those who seek to affect our rights and tell us how to live our lives. MTR’s lawyer will know she has no chance but they also know people who are threatened don’t want to test it in court so they bluff it by coming down hard with threats, and pretending they are entirely confident in their case. Its a well known tactic.

i think an important point is that, regardless of her literal religious beliefs, MTR is pushing the agenda and doctrines of fundamentalist christianity, disguised as reasonable argument. if you spend a decade or so (as i have) reading right wing christian literature, it is immediately apparent that much of MTR’s language and philosophical framework is directly inherited from avowedly fundamentalist christians (e.g. dobson’s Focus on the Family to name one of countless possible influences). if you attend one of these groups, you inevitably adopt their language (code) of “pro-family”, “pro-life”, “fornicating socialist atheists” destroying our “god-given rights” (etc. etc. etc.), otherwise you are incapable of having discussions within their particular framework whereby every position you share is obviously correct. personally, i can’t imagine anybody arguing with the stylistic content of MTR without being a faithful member of one of these groups

You say that it appears to be of little consequence to MTR that women in underdeveloped countries suffered and died as a direct consequence of Harradine’s religious beliefs, and her lobbying efforts, during the period when he was her employer. I saw this post on another of your articles that demonstrates that MTR doesn’t care about the sanctity of life, nor the true welfare of children. She really is quite an odious person, focused only upon self aggrandizement.

    ————–

I read with great interest the following passage between a Face Book member and Melinda Tankard Reist on her personal FB page. The exchange suggests to me that Ms Reist is far less interested in serious issues and immediate dangers to children from predators, say, as much as she is outraged by ‘sexist’ men’s magazines. It appears she likes publicity, more than reality.

    9 September ’11 at 18:40

    Richard Henderson –

“Ms Reist. Mandatory internet filtering promises disaster for our children. Kids commonly use free proxies to circumvent school network blocks. Many of these are, in fact, “honeypots” used by unscrupulous free proxy operators to exploit kids’ email and social networking accounts. Some are fronts for pedophile networks and predators that set-up virtual servers to lure their prey. Instead of tightening the net on pedophiles, mandatory censorship will create millions of additional trapdoors where perverts patiently lay in wait for our kids. Is that avoidable, direct danger to our children an acceptable outcome of mandatory censorship which you clearly supported on ‘The Drum’? Why do eminent groups such as Save the Children, National Children’s Youth Law Center, The Australian Library & Information Association and Civil Liberties Australia all oppose mandatory internet censorship? The immutable fact is that if Labor censor the Internet, kids and teens WILL use these proxies, swapping them like we used to exchange bubblegum cards. ISP level filtering, meanwhile, will give parents a false sense of security, believing their children are actually limited from accessing age-inappropriate material. Not opposing this mandatory internet filtering legislation means that we – well-intentioned people – are literally helping to push them closer to danger. Finally, there are free opt-in ‘Net Nanny’ filters, one less since the Rudd/Gillard administration removed the government subsidised platform, why do we need mandatory ones? I hope you will acknowledge this on Q&A

    Melinda Tankard Reist –

Thanks Richard. It is true motivated individuals will always be able to find their way to circumvent filters, however the purpose of the Governments policy to block RC content is to prevent inadvertent access to this harmful content so that the very many people who do not want to be exposed to it, won’t be. The Goverment’s (sic) policy is to only block RC content- child abuse material, sexual violence such as rape, bestiality, detailed promotion or instruction in crime or drug use and terrorism material. Just because some people break speeding laws doesn’t mean we shouldn’t have speed limits. The Government’s policy includes education, law eforcement (sic) and research recognising that there is no simple solution.

    Richard Henderson –

Thank you for your reply, Ms Reist. The ‘motivated individuals’ you refer to are largely Internet savvy children and teens who can effortlessly circumvent any filter in existence over a matter of minutes. I am saddened that you chose not to address the grave issue of ‘honeypots’ … the fact that mandatory Internet filtering will likely bring our children into DIRECT contact with sexual predators. I don’t really understand your analogy that because some people break speeding laws doesn’t mean we shouldn’t have speed limits; I put it to you that society has a duty of care whereby we should not risk putting a predator into closer proximity with our children. Would you not be personally devastated to find that a child had been abducted or sexually exploited as a result of their email or FaceBook account being hacked due to phishing schemes – scams made infinitely easier courtesy of mandatory filtering and ‘honeypots’? Clearly, you would. As I mentioned in my earlier post, ISP level filtering will give parents a false sense of security, believing their children are actually limited from accessing age-inappropriate material. Again, this false belief that the Net is safe, or safer even, will actually result in marked reductions in parental supervision. There is a raft of far better ways to counter child exploitation, many of which actually lead to convictions of the perpetrators. I agree that there is no simple solution; however, mandatory filtering plays no part in any solution when it INCREASES real risk – and achieves so little. Lastly, I would appreciate your thoughts on my previous question – why do eminent groups such as Save the Children, National Children’s Youth Law Center, The Australian Library & Information Association and Civil Liberties Australia all oppose mandatory internet censorship?
